1. Agreement
By purchasing from TradeListCSV ("we," "us," "our") you agree to these Terms of Service. If you do not agree, do not complete a purchase.
2. License and Permitted Use
Upon payment, we grant you a non-exclusive, non-transferable, single-business license to use the purchased CSV data for your own internal business purposes, including but not limited to:
- Direct outreach campaigns (email, phone, direct mail)
- CRM import and pipeline building
- Market research and analysis
This license is for a single legal entity only. Sharing files across organizations, franchises, or subsidiaries requires separate purchase or a written commercial license from us.
3. Prohibited Uses
You may not:
- Resell, sublicense, or redistribute the data in any form
- Incorporate the data into any database product or data service offered to third parties
- Use the data in any manner that violates applicable law
- Use the data to harass, threaten, or defraud any individual or business
Violation of these terms terminates your license immediately without refund and may result in legal action.
4. CAN-SPAM and Legal Compliance
All data is compiled from public business listings. You are solely responsible for ensuring your use complies with all applicable laws, including but not limited to:
- CAN-SPAM Act: All commercial emails must include a valid physical address, an opt-out mechanism, and honest subject lines.
- TCPA: You are responsible for compliance with the Telephone Consumer Protection Act for any automated or pre-recorded calls.
- GDPR / CCPA: If you operate in or target EU or California residents, you are responsible for compliance with applicable data protection laws.
- State laws: Some states have additional cold-calling or email marketing restrictions. Consult legal counsel if in doubt.
TradeListCSV is not your legal compliance officer. We provide data — how you use it is your responsibility.
5. Data Accuracy
Data is sourced from publicly available business listings and updated monthly. We do not warrant that the data is 100% accurate, complete, or current at the time of your use. Phone numbers, email addresses, and business details change frequently. We make no representation that any specific record is accurate or that the business is still operating.
We represent that we use reasonable processes to validate data quality before each monthly update. Our stated phone accuracy rate of 97% is an average across packs and is not a guarantee for any individual record or pack.
6. Refund Policy
Due to the digital and immediately-delivered nature of our products, all sales are generally final. We will, however, issue a full refund if:
- You contact us within 48 hours of purchase, and
- You provide specific evidence of a material data quality issue — for example, more than 10% of records being duplicates, blank, or categorically incorrect (e.g., a plumbers pack containing restaurants).
Refunds are not issued because you changed your mind, failed to use the data, or because outreach results did not meet your expectations.
To request a refund, email [email protected] within 48 hours with your order ID and specific issue details.
7. Limitation of Liability
TradeListCSV shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the data, including but not limited to lost profits, failed campaigns, fines, or legal costs arising from your outreach activities. Our total liability for any claim shall not exceed the amount you paid for the specific pack giving rise to the claim.
8. No Warranty
The data is provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the new Terms.
